Terms of Service

These Terms of Service ("Terms") govern your use of Amaichat LLC's ("Amaichat", "we", "us") AI-powered missed call recovery and customer communication platform ("Service"). By using our Service, you agree to these Terms.

1. Service Description

Amaichat provides small businesses with:

• Automated SMS follow-up messages when customer calls go unanswered
• AI-powered voice assistant (Amai) for answering inbound calls
• Appointment scheduling with Google Calendar integration
• Analytics dashboard for tracking calls, messages, and recovered revenue
• Multi-channel customer communication (SMS, WhatsApp, Instagram DMs)

2. Google Integration and API Services

Amaichat integrates with Google Calendar to enable appointment scheduling on behalf of business owners.

By connecting your Google account to Amaichat:

• You authorize Amaichat to access your Google Calendar solely to check availability and create appointment events as requested.
• Amaichat will not use your Google data for advertising, marketing, or any purpose unrelated to the scheduling service you requested.
• Amaichat complies with the Google API Services User Data Policy, including the Limited Use requirements.
• We do not retain Google Calendar data beyond what is necessary to provide scheduling functionality.
• We do not sell or share your Google data with third parties except as necessary to provide the service.

You may revoke Amaichat's access to your Google account at any time through your Google account settings. After revocation, Amai will continue to collect appointment requests but will no longer book directly to your calendar.

3. SMS Program Terms

Program name: Amaichat Missed Call Recovery & Customer Follow-up

Program description: Automated SMS messages sent to callers who placed an inbound voice call to a business using Amaichat. Messages include booking links, appointment confirmations, and follow-up information specifically requested by the caller during their phone conversation with our AI receptionist.

How we collect SMS opt-in consent. Consent is collected verbally during the inbound phone call. Our AI receptionist asks the caller, using these exact words:

"I can send you a text with your booking link, appointment details, or follow-up information from Amaichat. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Our privacy policy is at amaichat.com/privacy-policy. Would you like me to send that?"

SMS is sent only if the caller responds affirmatively. The caller's mobile number is the same number they used to place the inbound call — we do not purchase, scrape, or otherwise acquire phone numbers.

Message frequency: Typically 1 SMS per missed call or booking event. Additional messages may be exchanged if the caller replies and engages in a conversation. There are no scheduled promotional sends.

Message and data rates may apply. Check with your mobile carrier for applicable rates.

To opt out: Reply STOP to any message. You will receive an automatic confirmation, and no further messages will be sent to that number.

Mobile information sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile phone numbers, SMS opt-in consent, and SMS message content are never sold, rented, or transferred to any third party for marketing or promotional purposes. Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, US Cellular.

4. Business Client Responsibilities

As a business using Amaichat, you agree to:

• Only use the Service to contact customers who have called your business number
• Comply with all applicable laws including TCPA, CAN-SPAM, and CTIA guidelines
• Provide accurate business information during setup
• Honor opt-out requests immediately
• Not use the Service for spam, harassment, or illegal purposes
• Maintain a legitimate business with real customers

5. Subscription and Payments

Amaichat offers the following plans:

• Starter: $49/month
• Growth: $149/month
• Scale: $399/month

Subscriptions are billed monthly. Payments are processed securely through Stripe. You may cancel at any time. Cancellations take effect at the end of the current billing period. No refunds for partial months.

6. Acceptable Use

You may not use Amaichat to:

• Send unsolicited messages to people who have not contacted your business
• Impersonate any person or business
• Send spam, phishing, or fraudulent messages
• Violate any applicable law or regulation
• Resell or sublicense the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Twilio, OpenAI, etc.), and unforeseen events may cause temporary disruptions. We are not liable for losses resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Amaichat's liability for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate the service relationship at any time. We may terminate or suspend your account immediately for violations of these Terms. Upon termination, your data will be retained for 30 days then deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or SMS at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
